IP Australia have released draft legislation proposing amendments to the Australian Designs Act.

The introduction of a 12 month grace period for designers to apply for Australian Registered Design protection after using or publishing their design is a notable inclusion in the draft legislation.

Whilst a 12 month grace period currently exists in respect of Australian Patents, at present there is no grace period for Designs.
